A fugitive from justice is an individual who flees or evades apprehension, prosecution, or punishment for a criminal offense by crossing jurisdictional boundaries or concealing their whereabouts from law enforcement authorities. This legal status applies to persons who have been formally charged with a crime and intentionally avoid arrest, defendants who fail to appear for court proceedings after being released on bail, or convicted offenders who escape from custody or abscond from parole or probation supervision.
Abbell, M. (2010). Extradition to and from the United States (Vol. 1). Brill Nijhoff.
The classification of an individual as a fugitive from justice carries significant legal consequences affecting jurisdictional authority, procedural rights, and available remedies for securing custody. Interstate fugitives within federal systems are subject to rendition under provisions such as the United States Constitution's Extradition Clause requiring governors to surrender fugitives upon proper demand from the asylum state, implemented through the Uniform Criminal Extradition Act adopted in most American jurisdictions.
