Refers to the deliberation that courts undertake when deciding what type of services, actions, and orders will best serve a child as well as who is best suited to take care of a child.

In disputes over child custody, the judge will make a decision based on the child’s best interests. 23 U.S. jurisdictions list in their statutes the factors courts will consider in deciding what’s in the best interest of the child. But in general, the court will consider these main factors: the child’s age, gender, mental and physical health of the parents, ties between the parent and the child, the child’s preference, and ability of the parent to provide the child with shelter, food, clothing, education, financial support, and medical care.

En un juicio de guarda y custodia en el que debía determinarse si dos niños quedarán bajo el cuidado principal de su padre o de su madre, a la Corte le correspondía resolver —con base en el interés superior de los menores— si los jueces pueden analizar todas las pruebas que tengan o solo aquéllas que se relacionen con los argumentos presentados por los padres.
